Former Prosecutors on Your Defense Team
Two members of our criminal defense team, Andy Kyres and Herb Shaps, spent their careers as prosecutors before joining Alvarez Law Offices. That background means they know how Indiana prosecutors build sexual assault cases before a single motion is filed. They understand which evidence carries the most weight at trial, where charging decisions get made, and where procedural missteps create openings for the defense. That institutional knowledge is applied directly to the strategy we build for each client.
Combined with Walter Alvarez’s Indiana license dating to 1973 and over 200 years of combined legal experience across our team, we bring a depth of criminal defense perspective that genuinely shapes how we approach these cases. We’ve been serving clients across Indiana since 1970, and our attorneys are licensed to practice on both sides of the state line in Indiana and Illinois, which matters when cases cross county or state boundaries. Our firm is also a member of the Million Dollar Advocates Forum.
Accessibility is part of how we work. Clients receive direct access to their attorney’s personal cell phone, and our support staff of more than 30 people is available throughout the case. We’re reachable 24/7 by phone, text, email, and chat, and virtual consultations are available. Spanish language services are also offered for clients who prefer to communicate in Spanish.

Why Choose Alvarez Law Offices for Sexual Assault Defense in Indiana?
Every defendant is presumed innocent, and a thorough defense begins with understanding the specific facts and charges at hand. At Alvarez Law Offices, we approach each case as trial lawyers first, preparing for a jury rather than pushing for a quick resolution. Walter Alvarez has been licensed to practice in Indiana since 1973, and our attorneys hold licenses in both Indiana and Illinois, allowing us to serve clients whose cases cross state lines or span multiple counties.
Sexual assault cases demand a careful review of physical evidence, witness credibility, and consent under Indiana law. We account for recent changes in Indiana statutes and legal precedents that affect how charges are classified and argued, and we build individualized strategies rather than applying a blanket approach. Free consultations are available, including virtual consultations, so you can speak with our team without delay.

Why did Alvarez Law Office file the lawsuit?
Why did Alvarez Law Office file the lawsuit? We filed a proposed class-action lawsuit for several reasons. First and foremost, it allows us to subpoena records and get much-needed answers about what happened. The Hospital’s communications so far have been vague at best, and we are told that the Hospital’s helpline folks are no more helpful. Second, we want to preserve everybody’s rights. Third, we wanted to immediately start the process of asking the court to “certify” the case as a class action, and we have already filed a motion and brief with the court seeking that certification.Have questions? We are here to help. Still have questions or can't find the answer you need? Give us a call at 219-300-5204 today!

Workplace Accidents
A workplace accident is when a person is injured or killed on the job. When this happens, the employee may not be allowed to bring a personal injury lawsuit against their employer. If this type of accident takes place in the Chicago area or northwest Indiana, the employee or employee’s family will be required to file a claim under their localWorker’s CompensationAct. Once this action has been taken, the employer will be required to make various benefits available to the employee that has suffered a personal injury.
These benefits can include temporary total disability, medical treatment, and permanent partial disability, depending on the seriousness of the injury. Each state’s Worker’s Compensation law is different and can be tricky to navigate. You may choose to represent yourself as you work closely with your employer’s human resources when personal injury is minor. If you have sustained a significant injury, it may be best to acquire the services of a Workers’ Compensation attorney.

Premises Liability
Accidents caused by defective or dangerous conditions on someone’s property are referred to as premises liability. These types of personal injuries can happen on personal or commercial properties. So if you are in an accident at your neighbor’s house, a gas station, grocery store, restaurant, or a retail store, you may be entitled to financial compensation.
Situations covered under premises liability include falling down a staircase with missing handrails, being bitten by a dog, slipping on spilled liquids in an aisle, tripping over uneven walkways, to name a few. When dealing with commercial businesses or homeowners’ insurance, they may try to sell you short when it comes to the compensation they offer to cover your injuries. A personal injury lawyer can step in and ensure you are taken care of and given ample compensation for your troubles.

Wrongful Death
A case of wrongful death is usually due to someone’s carelessness. Cases such as these can be the direct result of truck or car crashes, medical malpractice, nursing home neglect, the use of dangerous or defective products, airplane accidents, or construction accidents. The loss of a loved one due to wrongful death negatively affects the family and brings hardships such as financial strain, heartbreak, and a sense of loss.
A personal injury lawyer is essential in this type of case as they can help determine the extent of damages that will need to be recovered due to the wrongful death. They can also help alleviate the overall stress of the situation by handling the legal process while the family and loved ones grieve. This may be the toug
Defense Strategies Against Sexual Assault Charges
Our approach involves an in-depth examination of every aspect of your case: the evidence, the witnesses, and any procedural missteps by law enforcement. Indiana’s legal system recognizes that not all allegations are substantiated, which is why we center our defense on the presumption of innocence and the constitutional rights every defendant holds.
Because Andy Kyres and Herb Shaps prosecuted these cases before joining our team, they know which arguments hold up and which tactics tend to fall apart under scrutiny. That knowledge directly shapes how we challenge the state’s theory at every stage.
We also work to humanize our clients and present their full story. Mitigating factors matter, and every opportunity to advance an alternative narrative gets a thorough look. Named defenses we evaluate on many cases include:
- Consent: Indiana law has specific criteria for what constitutes valid consent. When the evidence supports it, consent can be a central defense.
- False Accusation: When allegations lack corroborating evidence or appear motivated by personal conflict, we build the record that supports this defense.
- Mistaken Identity: In cases where identification occurred under difficult conditions, we challenge the reliability of that identification directly.
- Alibi: We gather witness statements, digital records, surveillance footage, and receipts to place our client elsewhere at the time of the alleged offense.
- Evidence Preservation: Collecting physical evidence, witness testimony, and expert opinions early protects against loss or degradation before trial.
- Pretrial Suppression Motions: When law enforcement didn’t follow proper procedures, we move to exclude improperly obtained evidence before trial.
- Witness Credibility: In cases that rest on a single victim statement without forensic support, challenging the consistency and credibility of that statement is a critical avenue.
- Negotiating with Prosecutors: When appropriate, we can negotiate to reduce charges or seek favorable plea agreements, informed by our former prosecutors’ understanding of how those decisions get made.
Frequently Asked Questions About Sexual Assault Charges in Indiana
What Should I Do if I Am Accused of Sexual Assault in Indiana?
Stay calm and don’t make any statements to law enforcement without an attorney present. Contact a sexual assault attorney in Indiana as soon as possible so your rights are protected from the start. At Alvarez Law Offices, we provide initial consultations to go over your situation and answer your questions.
Anything you say before speaking with counsel can be taken out of context and used against you. Our team intervenes early to safeguard your rights and lay the groundwork for an effective defense.
How Does Indiana Law Define Sexual Assault?
Indiana defines sexual assault offenses under Title 35, covering charges such as rape, sexual battery, and criminal deviate conduct. Severity is determined by factors including the victim’s age, use of force, and whether a weapon was involved. Consent is a central issue in many of these cases, and Indiana law sets specific criteria for what qualifies. We can walk you through exactly what the charges mean and what your options are.
What Are the Possible Penalties for Sexual Assault in Indiana?
Penalties range from 6 months to 40 years in prison depending on the felony level, plus fines up to $10,000 and potential sex offender registration under Zachary’s Law, which can restrict where you live, work, and travel for years or a lifetime. The impact extends far beyond the courtroom, reaching employment, housing, and personal relationships. A sexual assault lawyer in Indiana from our team can pursue available defenses and explore alternatives where the facts support them.
Do I Need Dedicated Legal Representation for Sexual Assault Cases?
Yes. These cases are among the most complex in criminal law, involving evidentiary, procedural, and statutory issues that require a defense team with direct experience handling sex crime charges in Indiana. At Alvarez Law Offices, our former-prosecutor insight and individualized approach mean your defense is built around the specific facts of your case, not a generic template.
